Abstract

Analyses the Court of Appeal rulings in: (1) Majrowski v Guy's and St Thomas's NHS Trust on whether a hospital was vicariously liable to compensate a hospital employee for harassment committed by a manager in breach of the statutory duty imposed on her personally by the Protection from Harassment Act 1997 s.3; and (2) Banks v Ablex Ltd on whether an employee was entitled to claim damages from her employer for statutory harassment she allegedly suffered from another employee, including looking at whether a claim for harassment could be based on behaviour occurring on one occasion and whether the employer should have foreseen that the claimant was at risk of suffering injury to mental health.
