Abstract

Explores the House of Lords ruling in Majrowski v Guy's and St Thomas's NHS Trust on whether the Court of Appeal had erred in its decision upon whether an employer was vicariously liable for harassment by an employee in the course of their employment, where such actions were in breach of the Protection from Harassment Act 1997 s.3. Examines the opinions given by the Lords and how they assessed the previous decision, in particular the minority judgments. Notes the implications for employers.
