Abstract

Reviews the Court of Appeal decision in Daw v Intel Corp (UK) Ltd on whether an employer failed to manage the stress placed upon an employee by her workload which resulted in psychiatric harm. Considers whether the employer should have foreseen the risk of harm and whether the provision of a confidential counselling service to employees was a sufficient measure. Comments, with reference to case law, on the role of counselling services in helping discharge employers' duty of care.
