Abstract

This article explains the decision of the House of Lords in the hearing of the combined cases of Johnston v NEI International Combustion Limited, Rothwell v Chemical and Insulating Company Limited and others, Topping v Benchtown Limited and Grieves v F T Everard & Sons and others
[2007] UKHL 39. The legal rule is no action lies for a wrong which has not resulted in some element of loss, injury or damage of a kind that was reasonably foreseeable and for which the claimant can sue. It is the limits of this, most basic, principle of the law of negligence that are under scrutiny in these appeals.
