Abstract

The article is a commentary of the Roper v Simmons US Supreme Court case, by which the Justices abolished the death penalty for minors on the grounds that such practice clashes with the 8th amendment to the US Constitution, which prohibits cruel and unusual punishment. The paper gives an overview of the existing case law of the Inter-American Commission on Human Rights in relation to the use of the death penalty against juveniles in the United States, as well as an analysis of the consequences of the decision on the existing United States' reservation to Article 6 of the UN International Covenant on Civil and Political Rights.
