Abstract | This book chapter examines the legal regime for dealing with local public entities [LPEs] in financial distress in Uganda as one of the developing economies in Sub-Saharan Africa. It analyses the efficacy of the Insolvency Act 2011 as the main legislation governing insolvency proceedings in Uganda, and the absence of a special regime and/or framework for dealing with LPEs, such as governmental parastatals, municipalities, local districts, public hospitals, etc., undergoing financial distress. Case studies are undertaken of two recent LPEs that underwent financial resolution and the role of the state in dealing with such entities. |
