Abstract

The doctrine of abandonment highlights one of the dilemmas in land law, which is the relationship between the ‘community’ or ‘social’ interest in land and the individualism of private ownership. The Supreme Court decision in Hillside Parks Ltd v Snowdonia National Park Authority that there is no principle of abandonment or extinguishing by abandonment of planning permission, raises issues of wider importance in land law. It is hoped that the lively debates and range of views investigated will bring renewed interest to the issue of abandonment.
