Abstract

This article is concerned with considering the first cases at the European Court of Justice concerned with the age aspects of Council Directive 2000/78/EC establishing a general framework for equal treatment in employment and occupation. The cases illutrate the wide discretion given to the Court in deciding whether exceptions to the principle of non-discrimination can be justified as having legitimate aims achieved by proportionate means.
