Abstract | The right of everyone to « enjoy the arts » is set out in article 27 of the Universal Declaration of Human Rights. The travaux préparatoires indicate that this was an original contribution by John P. Humphrey, who prepared the first draft of the Declaration. The reference to « the arts » was dropped when the two Covenants were adopted. There has been a tendency to more general references to culture without making the distinction between manifestations of popular culture and the fine arts, such as classical music and opera, theatre, painting and sculpture. Nevertheless, the Convention on the Rights of the Child affirms a right « to participate freely in cultural life and the arts ». Article 32 of the Hague Convention affirms the immunity of the musicians who accompany the parlementaire, thereby acknowledging the contribution of music to peacemaking. |
